White House Clears Rule for Nationwide CBP Biometric Exit Program

The White House has approved a regulation that advances the U.S. government’s long-planned biometric exit program, clearing the way for nationwide implementation of facial recognition checks on departing non-U.S. citizens. The rule was cleared by the Office of Information and Regulatory Affairs (OIRA) and removes the “pilot program” limitations that have governed biometric exit for more than a decade.

From Pilot Programs to National Framework

Until now, U.S. Customs and Border Protection (CBP) could collect biometric data at land crossings only through pilot projects, and at no more than 15 air and sea ports of entry. The new interim final rule eliminates those restrictions, giving CBP authority to require photographs of non-citizens at exit points as part of routine departure procedures. The change fulfills post-9/11 mandates calling for stronger border security through biometric identity systems, first authorized under the Enhanced Border Security and Visa Entry Reform Act of 2002.

CBP has already tested the approach in limited settings. Earlier this year, Orlando International Airport partnered with CBP to streamline passenger identity checks with biometric matching. Other ports have piloted facial recognition for cruise ship departures, demonstrating how the technology can verify travelers against existing travel document data in seconds.

Traveler Verification Service and Privacy Protocols

The expansion is built on CBP’s Traveler Verification Service (TVS), a cloud-based system that compares live images taken at gates, inspection booths, or jet bridges to galleries created from passport, visa, and flight manifests. When the system finds a match, officers or carriers receive confirmation; travelers who are not matched must present their physical documents for manual inspection.

CBP has emphasized that different privacy rules apply depending on traveler status. According to its biometrics privacy policy, photos of U.S. citizens captured during the entry or exit process are used only for identity verification and are purged from the TVS cloud within approximately 12 hours. Photos of in-scope non-citizens may be retained longer in Department of Homeland Security systems, such as ATS-UPAX, for analysis and enforcement purposes. DHS has published privacy impact assessments documenting how images are collected, stored, and disposed of.

Part of a Broader Security Modernization

The regulatory change comes alongside broader travel security updates, including the upcoming requirement for REAL ID compliance in domestic air travel. Together, these measures are intended to create a more secure identity verification environment across U.S. borders and airports.

CBP has been experimenting with biometric exit methods since the mid-2010s, beginning with fingerprint scans and small departure tests. The agency gradually moved toward facial comparison as the preferred tool, citing faster throughput and higher accuracy. Federal Register notices and successive privacy assessments have documented this evolution, building the legal and operational foundation for the rule that now enables broader rollout.

While the new regulation authorizes biometric exit nationwide, practical implementation is expected to proceed in phases. Airports and seaports will expand use of the Traveler Verification Service in partnership with airlines, cruise lines, and technology providers, with full deployment depending on funding, infrastructure, and ongoing privacy oversight.
