Senators Urge ICE to Halt Mobile Fortify Facial Recognition Over Privacy and Accuracy Risks

A group of U.S. Senators led by Ron Wyden, Jeff Merkley, and Ed Markey is urging Immigration and Customs Enforcement (ICE) to halt the use of its Mobile Fortify facial recognition application, citing risks to privacy, civil liberties, and accuracy that could disproportionately affect communities of color. The call comes in a letter to Acting ICE Director Todd Lyons that focuses on Mobile Fortify’s capability to perform real-time face scans and biometric checks in the field, reflecting growing concern over ICE’s expanding biometric surveillance footprint.

What the senators are demanding

The senators, joined by Elizabeth Warren, Cory Booker, Chris Van Hollen, Bernie Sanders, Adam Schiff, and Tina Smith, ask ICE to cease using Mobile Fortify and to provide detailed information by October 2. The letter highlights documented performance disparities in facial recognition systems, especially for people of color, and warns that increased reliance on the technology could amplify harms in communities that already face heavy surveillance. In the absence of comprehensive federal rules for facial recognition, the letter situates Mobile Fortify within a broader policy debate in which states are moving ahead with their own measures to govern biometric tools.

Why Mobile Fortify is under scrutiny

The lawmakers describe Mobile Fortify as part of a larger surveillance ecosystem that includes data from commercial brokers, Department of Motor Vehicles databases, cell-site simulators, and other biometric systems. They argue that this network raises constitutional and civil liberties questions, including potential impacts on free association and due process. The letter reiterates long-standing concerns about facial recognition accuracy, noting that errors have been shown to fall unevenly across demographic groups. It also places the app’s field use against a funding backdrop that has accelerated the uptake of sensors and analytics at the border, following recent congressional appropriations for surveillance technology.

In addition to asking ICE to suspend the app, the senators request comprehensive documentation about Mobile Fortify’s development history, deployment timeline, accuracy and bias testing, legal authorities, current use policies, and any safeguards that govern when and how agents may run scans. They also ask ICE to explain its position should the agency decline to stop using the technology. The letter underscores that multiple attempts to establish federal limits on biometric surveillance remain pending, including renewed efforts to restrict certain federal uses, as noted in ongoing legislative proposals.

The exchange adds urgency to a nationwide conversation about the role of facial recognition in domestic enforcement.
