Privacy Groups Challenge Asda’s Facial Recognition Trial in UK Stores

Privacy advocacy organizations have filed a legal complaint with the UK’s Information Commissioner’s Office (ICO), challenging Asda’s use of live facial recognition technology in select supermarkets. The complaint alleges that Asda’s deployment of the technology is unlawful and raises significant privacy and data protection concerns.

Facial Recognition Trial Raises Legal and Ethical Questions

The formal complaint – filed by groups including Privacy International and Big Brother Watch – follows a recent two-month trial conducted in five Greater Manchester stores. The system, powered by Facewatch technology, was introduced to help combat retail crime. However, civil rights groups argue that the program constitutes invasive surveillance and may violate UK data protection laws.

Under the UK General Data Protection Regulation (GDPR), biometric data, including facial recognition, is classified as “special category data.” This means it requires a strong legal basis for processing and clear safeguards for individuals. The complaint contends that Asda failed to provide sufficient transparency, did not establish an adequate legal justification for the technology, and lacked robust protections for affected individuals.

Experts Warn of Risks in Retail Biometric Deployments

Professor Fraser Sampson, former UK Biometrics & Surveillance Camera Commissioner, has consistently warned against the uncritical rollout of such systems. “This is not just any data processing, this is biometric processing,” he stated in 2023. “Major retailers have deep and wide experience handling customer data at macro level, but biometrics are elementally different.”

Privacy groups have cited a lack of clear signage or notifications for customers, the questionable legal basis for collecting sensitive data, and broader concerns about normalizing surveillance in everyday settings. They argue that embedding facial recognition into retail environments could have long-term implications for civil liberties and public trust.

While interest in biometric technologies continues to grow across industries, the Asda case highlights persistent tensions between innovation and privacy rights. It has also renewed calls from experts like Sampson for stronger ethical, legal, and technological safeguards when implementing biometric systems in public-facing environments. “The opportunities for missteps are many and the consequences profound,” Sampson warned.
