EU Court Accepts Gait Recognition Evidence in Murder Case

A European criminal court has accepted gait and body-structure biometrics as admissible evidence in a murder prosecution, marking a notable expansion of the modalities that can be used in criminal proceedings. The decision highlights how technologies beyond fingerprints or facial scans are beginning to play a role in courtroom settings, even when conditions make traditional methods ineffective.

The case centered on a killing that was partly captured on unsynchronized night-vision cameras positioned about 30 meters away. Because of poor lighting, occlusion, and awkward camera angles, facial recognition could not be applied. Investigators narrowed their focus to two suspects and obtained reference recordings of each walking. A biometric provider, Cursor Insight, analyzed the footage and extracted 31 static and dynamic gait parameters. One was found to be inconclusive, but the other 30 aligned consistently with a single suspect. That analysis was submitted in a forensic report, and the court accepted it as valid evidence for the trial.

The ruling demonstrates how hybrid biometric approaches that combine gait and physical body structure are gaining traction as tools for forensic investigations. While gait is typically less accurate than face or fingerprint recognition in ideal conditions, the court accepted that sufficient distinguishing features remained available even under the poor circumstances of the recording. The case also illustrates how admissibility is determined at the national level. Within the European Union, thresholds for what constitutes reliable biometric evidence still vary significantly by jurisdiction.

This development follows earlier attention to gait recognition in non-judicial contexts. ID Tech previously reported on the EU’s PopEye project, a pilot program designed to test gait recognition at European borders as a means of verifying the identity of individuals “on the move.” The courtroom use of gait evidence and the border security pilot both point to a growing interest in modalities that can identify individuals when facial recognition is unreliable or impractical. At the same time, they underline the concerns of civil liberties advocates, who argue that biometric surveillance risks expanding without sufficient protections.

The ruling leaves important questions unresolved. Courts and researchers will need to establish how error rates for gait recognition are quantified, what video standards will be required for defensible evidence, and how much transparency about algorithms and parameter extraction must be disclosed so defense teams can challenge the findings. More broadly, privacy and human rights issues remain unsettled, since gait recognition can function even when faces are obscured and individuals are unaware they are being recorded. These issues will continue to test the balance between the utility of new biometric technologies in law enforcement and the protections demanded under GDPR and other legal frameworks.
