A Brazilian court has ruled in favor of NSX Brasil, allowing the betting operator to continue its activities after successfully demonstrating the use of biometric verification systems designed to prevent minors from accessing its platforms. The ruling came in response to a high-profile lawsuit seeking BRL 500 million (approximately $88.3 million) in damages, along with the suspension of NSX’s operations.
Court Rejects Suspension Request, Cites Compliance
The Court of Justice of the Federal District and Territories (TJDFT) declined to issue a preliminary injunction against NSX Group, the parent company of popular betting platforms including Betnacional, Mr. Jack Bet, and Pagbet. The lawsuit had been brought by Educafro and the Father Ezequiel Ramin Centre for the Defence of Human Rights, which accused the company of failing to prevent underage gambling.
NSX defended its position by demonstrating that its platforms incorporate facial recognition-based biometric verification systems to verify user identities and block underage access. The court acknowledged these measures, as well as NSX’s licensing status, confirming that the company had obtained proper authorization from the Prizes and Betting Secretariat (SPA) of the Ministry of Finance to operate in Brazil’s regulated online betting market.
Legal Commentary Emphasizes Importance of Licensing and Compliance
Legal experts noted that the ruling underscores the need for demonstrable evidence before imposing punitive measures on licensed operators. Betting law specialist Udo Seckelmann told iGaming Business that the decision emphasized the absence of proof that Betnacional had targeted minors or violated laws protecting children and adolescents. He added that the case highlights how critical it is for operators to maintain strong compliance systems and obtain proper regulatory authorization.
The use of advanced identity verification systems is becoming a key requirement for betting platforms aiming to meet evolving compliance standards and protect vulnerable populations. NSX’s successful legal defense is likely to serve as a precedent in Brazil, reinforcing the role of biometric technologies in aligning digital platforms with national gambling regulations.
The court’s decision allows NSX to continue operations without interruption while the case proceeds. It also sends a message to the broader betting industry that proactive implementation of identity safeguards can provide crucial legal protection in a tightly regulated environment.
